Agreement and operator These Terms of Service ("Terms") govern the Onyxpane Windows VPS service, the website at https://onyxpane.com and the customer dashboard. The service is sold and run by DomaineGoat LLC, a limited liability company registered in Panama. In these Terms, "we" means DomaineGoat LLC, and "you" means the holder of the account. By opening an account, topping up a balance or using a server, you accept these Terms. Who can use the service - Accounts are for people aged 18 or over. - Not available to people or companies in Cuba, Iran, North Korea, Syria, Russia, Belarus, China, Yemen or Western Sahara, or in the occupied regions of Ukraine. - You must not be on a sanctions list, and you must not use the service for a person or company that is. - You must be able to make a binding contract where you live. ## 3. Accounts Sign in with an account number; an email address is optional. No KYC: no ID, no selfie, no documents, no card, no phone number. - Your account number works as your password: whoever holds it controls the account, its balance and its servers. - Your account number is how you sign in, so store it carefully. With an optional email on file you can recover it; with no email, a lost number is gone for good. - You are responsible for everything done with your account number and with the Administrator passwords of your servers. - Nobody from our team will ever ask for your account number or your Administrator password, by email or in a chat. ## 4. Windows license and Microsoft software The Windows Server license is included in the price: no extra license fee. - The license comes with the server from the datacenter provider that hosts it, under that provider's license from Microsoft. Administrator access and Remote Desktop You log in as Administrator over Remote Desktop on port 3389; the temporary password appears in your dashboard and you change it at first login. - The temporary password is shown to your account only, masked until you choose to show it. - Change it at your first login. The team never learns the password you set, and never asks for it. - The `.rdp` file of your dashboard is built in your browser, and the password is never in it. - Connect from Windows (Remote Desktop Connection), macOS, iPhone, iPad and Android (Microsoft’s Windows App) or Linux (Remmina or FreeRDP). - After delivery, you are responsible for the security of the server: passwords, Windows updates and firewall rules. A person answers support emails within 12 hours, seven days a week, including help with Remote Desktop connections, reinstalls and Windows Firewall rules. ## 7. Prices and payment Prices are in US dollars for one 30-day period, as listed on the pricing page, and include the Windows license. - Payment is in crypto only: BTC, USDT, USDC, ETH, SOL, LTC, XMR. USDT is taken on Tron (TRC-20) or Ethereum (ERC-20), and USDC on Ethereum (ERC-20). Bitcoin is taken on-chain only. Monero is sent to our Monero address and credited after 10 confirmations. Lightning is not accepted. - You top up a prepaid balance, from a $1 minimum, and each 30-day period is paid from that balance. - Send the exact amount to the address and on the network shown on the payment page. A payment sent on another network can be lost. - You pay the network fee of your own transaction. - Payments in BTC, USDT, USDC, ETH, SOL and LTC carry their sender’s address on the chain, and that address is compared with public sanctions lists of blockchain addresses; a payment from a listed address is not credited. Monero hides the sender, so a Monero payment leaves no address for this comparison. - A price change applies to new orders. A period already paid keeps the price you paid for it. ## 8. Delivery A person creates your server once your payment is confirmed, and it is online within minutes of that confirmation, with one hour as the ceiling; your dashboard shows the status, then the IP address and the Administrator password once the server is running. The 30 paid days start when the server is ready, not when you pay. If a server cannot be set up, it is not created and its price stays on your balance, as the refund policy states. ## 9. Periods, renewal, suspension and deletion A Windows VPS is paid for 30 days at a time from your prepaid crypto balance. With auto-renew on, it renews from the balance; if the balance does not cover the next 30 days, the VPS is suspended at the end of the period, its disk is kept for 7 days, then deleted. - **Early renewal:** you can renew a server from your dashboard before its period ends. - **Auto-renew off:** the server is suspended at the end of its paid days, with the same 7-day keep period. - **Restart after suspension:** a renewal within the 7 days starts the server again with its disk as it was. After them, the disk is gone for good. - **Deletion:** deleting a server ends it and erases its disk. The days left on it are not credited back. - **Reinstall:** a reinstall erases the disk, installs the Windows Server edition you choose and comes with a new temporary Administrator password. ## 10. Your data and backups No automatic backups are included: keep your own copies of anything that matters. You are responsible for the data on your server and for keeping copies of it. Nobody can recover a disk after a reinstall, after a deletion or after the 7-day keep period. ## 11. Network, traffic and mail - Every server has one dedicated IPv4 address. Traffic quotas count outgoing data per 30-day period; over the quota there is never an automatic extra charge. - Outgoing port 25 (SMTP) is closed on every server to stop spam, and it stays closed. Ports 465 and 587 to mail providers stay open. - You must not use the IP address of your server in a way that the [acceptable use policy](https://onyxpane.com/acceptable-use/ "What you can and cannot run on an Onyxpane Windows server") prohibits. ## 12. Acceptable use The acceptable use policy is part of these Terms. No carding or payment fraud, no use of stolen accounts or identities, no credential stuffing or brute-forcing of other people’s systems, no spam or bulk email, no phishing, no malware or botnet control, no DDoS or other attacks, no booter or stresser services, no child sexual abuse material, no cryptocurrency mining, and no service to sanctioned people or companies. You are responsible for what runs on your server and for anyone you give a Windows login on it. ## 13. Copyright notices and applicable law DMCA ignored: we do not act on DMCA notices or other foreign copyright notices. We answer only to Panamanian law and to orders of Panamanian courts. Onyxpane is run by DomaineGoat LLC, a company registered in Panama, and answers only to Panamanian law. The datacenter that houses each server is in its own country and follows that country’s law. We hand over records only on an order of a Panamanian court. The privacy policy lists the records that exist; connection logs, traffic logs and IP addresses of visitors or customers are not among them. ## 14. Suspension We suspend a server in two cases: - its paid days end without a renewal (section 9); - it is used in a way the acceptable use policy prohibits, whoever started that use. DMCA and foreign copyright notices are ignored; only Panamanian law and Panamanian court orders apply. Carding and payment fraud, credential stuffing and brute-force attacks, spam, phishing, malware, botnet control, other attacks and child sexual abuse material are not allowed and lead to suspension. A suspended server shows as suspended in your dashboard. A server suspended for a breach of the acceptable use policy gets no credit for its remaining days. The refund policy covers only the cases it lists. To appeal, write to support@onyxpane.com with the order reference and the IP address of the server. You can stop using the service at any time by deleting your server. ## 15. Availability We do not promise a specific uptime. Maintenance, the datacenter network and events outside our control can interrupt a server. No DDoS protection is promised beyond what the datacenter network does by default. If a server does not run and support cannot fix it, the days it did not run go back to your balance. We can add or remove plans, locations and Windows editions for new orders; a 30-day period already paid is not changed. ## 16. Disclaimers The service is provided "as is" and "as available". We do not promise that a server suits a given purpose, such as trading, gaming or a given program. We do not promise a given latency to a broker, an exchange or any other service. We do not promise that a given website or service accepts the IP address of your server. Nor do we promise that IP location databases place it in a given country. ## 17. Limitation of liability As far as the law of Panama allows, we are not liable for indirect or consequential losses, lost profits, lost trades or lost data. Our total liability for any claim is limited to the price of the 30-day period of the server the claim concerns. Nothing in these Terms limits a liability that Panamanian law does not allow us to limit. ## 18. Indemnity You cover our reasonable costs and losses from claims by third parties caused by your breach of these Terms or of the acceptable use policy. ## 19. Governing law and courts These Terms and the service are governed by the law of the Republic of Panama. The courts of Panama have exclusive jurisdiction over any dispute about these Terms or the service. ## 20. Changes and language We can update these Terms. The date at the top shows the version in force, and a change applies from that date to new orders, renewals and continued use.
